Request: Variances in the R-1 zoning district for the construction of a single-family residence as follows: 1) To allow a north side setback of 4 ft. in lieu of 6 ft. 2) To allow a front setback of 18 ft. in lieu of 25 ft.

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that no comments were received in favor of the request, and two (2) comments were received in opposition to the requests. The applicant discussed the size of the property and the need for the request, and no options to decrease the size of the proposed residence. There were two (2) in attendance to speak in opposition of the request and discussed concerns of water contamination and not being consistent with the neighborhood. There was no one in attendance to speak in favor to the request. The BZA discussed the request determining the side setbacks do not provide adequate space to access the drain field and septic tank, and the proposed residence is a detriment to the neighboring properties. The BZA unanimously recommended denial of the Variances by a 5-0 vote, with one absent and one seat vacant (D5).
