SE-03-09-061 — Orange County Sportsmen's Association
Request: Special Exception in R-CE (single family-1 acre lots) zone as follows: 1) Expand private recreational use onto property located at 9012 Kilgore Road. This property is located due north of the existing association property; 2) Modify condition of Board of County Commissioner's Special Exception approval of November 28, 1995, restricting association membership to 1,500 people. (Applicant is requesting 1,800 people).

Hearing: The Staff Report and Recommendation is located on Pages____. It was pointed out at the BZA hearing that the applicant had withdrawn a proposal for the County to use the Association's existing facilities and the proposed expansion parcel to north as a public boat launching and parking facility. This was an important point because there was a great deal of public opposition, as well as opposition from within the realms of the Association membership to allow for this public use. The Association officially announced this withdrawal at the zoning community meeting and put forth that withdrawal in a letter to the County's Real Estate Management Department (copy attached). Notwithstanding the above withdrawal, the Association still wished to pursue purchase of and Special Exception approval to use the expansion parcel to the north for additional recreational activities for its members. A part of the Special Exception application included a request to allow an additional 300 members. Withdrawing the public use proposal allowed the applicant an opportunity to revise the site plan and design a less intense use of the property. The Association proposed a passive recreational use designed in a park-like fashion. With the help of a landscape architect, they met with the neighboring property owner (Mr. Ijaz Ahmed) to the north of the expansion parcel to address his concerns related to noise, aesthetics, and privacy. The meetings resulted in an agreement between the two parties on a Revised Site Plan/Landscape Plan, and a set of conditions written by staff. At the BZA hearing, Mr. Ahmed addressed the Board and stated his agreement with the revised plan and the conditions proposed for Special Exception approval. The president of Reserve at Cypress Point Homeowner's Association was at the public hearing and stated their support of the Special Exception application.
