Summary of the decision
SE-04-03-115 — LARRY & TRINA MURRAY
Request: Special Exception in A-2 (agricultural) zone for a Family Lot Provision. (NOTE: The applicant wants to construct 4 homes on approximately 22 acres of land. The proposed homes are for the applicant, the applicant's mother and father, the applicant's sister, and the applicant's father-in-law).
Decision: Approved
Hearing: The Staff Report and Recommendation is located on Pages______. The applicant wants to build 4 homes on 22 acres of land. Each parcel will be a minimum of 5 acres in size. The applicant has satisfied all conservation area/wetland concerns. Staff informed the BZA that these wetland issues needed to be resolved prior to placing this item on the agenda. The applicant has submitted all required mitigation plans to the Environmental Protection Division. Staff concluded the request meets the criteria for granting Family Lot Provisions. An adjacent neighbor spoke in favor of the request. He inquired as to whether the applicant would commit to residing in the new homes for at least 7 years rather than 3 years. The applicant informed the BZA they had no objections to being required to reside in the homes for a minimum of 7 years. The BZA amended condition of approval #2. There was no opposition.
