Request: Variance in C-2 (general commercial) zone to allow existing commercial building to remain with a zero (0) ft. rear yard setback in lieu of 15 ft. (NOTE: Applicant is splitting the parent parcel into two (2) parcels. The existing one-story building does not meet the rear yard setback from the proposed lot line).

Hearing: Applicant is requesting to subdivide the property through the lot split process. In order for the applicant to receive approval for the lot split it is necessary to obtain approval for a variance to the rear yard setback. The parent site contains two separate uses (I.e., hotel and restaurant). The restaurant is to be sold independently of the hotel which required the necessity of a variance along the rear yard. Applicant stated that the site will continue to function as one development site with cross parking and access agreements. No one spoke in opposition to the request.
