Request: Variances in the R-CE zoning district to allow the construction of a detached accessory structure as follows: 1) To allow a detached accessory structure (garage) in front of the primary structure. 2) To allow a front south setback of 22.5 ft. in lieu of 35 ft.

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial of the Variances since there are other alternatives to meet Code requirements. Staff noted that no comments were received in favor of the application, and two comments were received in opposition. The applicant discussed the need for the Variances was due to the soil conditions, the configuration of the property and that the proposal will not negatively effect adjacent properties. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the configuration of the property, the soil conditions and the ability for the improvements to be redesigned and relocated to meet Code requirements, the inconsistency of the proposal with the 6 Variance criteria, and recommended denial of the variances by a 4-2 vote, with one absent.
