Request: Special Exception in the A-1 zoning district to allow for the construction of a 737 seat 43,190 sq. ft. religious institution. 4/26/22 BOARD-CALLED

Decision: Denied

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that 77 comments were received in support, and 89 comments were received in opposition. The applicant presented an overview of the values of the church, and how they intend to relocate their Winter Garden operation to this site. They stated that they want a campus that would allow them to provide large buffers and building setbacks, greater than required by code, and 65% open space. They noted that there will not be a school and there will be no hosting of sporting events. In regards to compatibility, they noted that the adjacent single-family homes to the south are on one quarter acre lots, and the City or County owns adjacent lands for water treatment. 12 people spoke in favor of the request, stating that they think very highly of the church, many of whom moved to be near this church. They also felt that this location would be good for the community as it would buffer the higher density areas to the south. 4 people spoke against the request, stating that the use does not belong in a Rural Settlement, but rather belongs in a commercial area. They expressed concerns about environmental issues and traffic, and preservation of Rural Settlements. An attorney representing the applicant stated that adjacent properties are used for water treatment, and that the site is on the edge of the Rural Settlement, and that they are working with staff on traffic. The BZA felt the size of the church and that the scale is too large for a Rural Settlement and noted that the residents want to preserve what they have. However, the BZA also noted that the site chosen is on the edge of the Rural Settlement, adjacent to an urban area and noted that a church can also support the community.
