Request: Variances in the R-1AA zoning district as follows: 1) To allow a side street (north) setback of 12 ft. in lieu of 15 ft. 2) To allow a rear (west) setback of 26 ft. in lieu of 35 ft. (this variance is not necessary as the owner aggregated the lot to the rear with their existing lot).

Decision: Approved

Hearing: The applicant is proposing additions to their existing residence. The applicant owns the lot to the rear and is required by condition #4 to aggregate that lot with their existing lot. The code states that when adjacent lots are under single ownership and do not meet the minimum development standards they do not qualify as lots of record. The applicant agreed to aggregate the lots and therefore variance #2 is not needed. Staff noted that variance #1 from the side street is minor and this portion of the house will be obstructed from view by the existing hedge on site. The applicant agreed with staff's presentation and stated they had already begun the aggregation process. No one spoke in favor or in opposition of the request. The BZA found the variance met the criteria and approved the request.
