Request: Variance in R-1A to construct a single family residence 20 ft. from rear property line in lieu of 30

Decision: Approved

Hearing: The applicant is requesting a variance in the R-1A zoning district to permit a reduction in the rear setback from 30 ft. to 20 ft. Staff explained that the property abuts commercially zoned property on the south and west side, and that this commercial property is developed as a motel. It was also noted that there is a six foot tall masonry wall extending along the commercial properties rear which abuts the subject property. Also, due to the irregular shape to the rear property line, the applicant has lost over 30 ft. of usable rear yard. The applicant indicated there agreement with the staff recommendation and the conditions proposed by staff. There being no one in the audience to speak for or against the request. The BZA found that the irregular shape of the rear lot did render the lot unusable without the variance, and that the applicant did not create the irregularity.
