Request: Variance in the R-CE zoning district to allow a detached accessory structure with a maximum height of 26.4 ft. in lieu of 25 ft.

Decision: Approved

Hearing: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that no comments were received in favor of the request, and two (2) comments were received in opposition to the request. The applicant was present and spoke about the need of the Variance to protect the RV from the elements and that the height is necessary to accommodate the RV. The applicant noted that they had stored the RV in compliance with the Code, but that having it outside caused damage to it, which is why they requested the Variance. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the request and similarities to previous requests. The BZA noted that it is only 16 inches above the maximum building height, and for only a portion of the garage, and is the minimum possible to accommodate the RV. The BZA noted the applicant would be deprived of the right to construct a garage for the RV. The BZA unanimously recommended approval of the Variance by a 7-0 vote, subject to the four (4) conditions found in the staff report, with the addition of Condition #5 as follows: 5. The proposed garage building shall be constructed of the same material as the current house and painted in the same color palette as the current house.

Conditions: 1) Development shall be in accordance with the site plan and elevations dated February 11, 2025, subject to the conditions of approval, and all applicable laws, ordinances, and regulations. Any proposed non-substantial deviations, changes, or modifications will be subject to the Zoning Manager's review and approval. Any proposed substantial deviations, changes, or modifications will be subject to a public hearing before the Board of Zoning Adjustment (BZA) where the BZA makes a recommendation to the Board of County Commissioners (BCC).
