Request: Variance in R-1A (single family-7,500 sq. ft. lots) zone to construct addition (family room and bathroom) to single family residence 25 ft. from rear property line in lieu of 30 ft.

Hearing: The applicant wants to construct a bathroom and family room addition to the back of his home 25 ft. from the rear property line in lieu of 30 ft. The subject property is located within the Winter Park Pines Merrie Oaks Subdivision south of Aloma Avenue. There is no mandatory HOA but there is a voluntary organization which the applicant submitted a letter from with no objection to this request. In addition, the applicant submitted 7 letters of support from adjacent homeowners that would be directly impacted by this request. It was brought to staff¿s attention that the applicant is operating a daycare home and that the possible expansion would be utilized to expand the daycare operations. The applicant stated that the addition would be constructed for the family¿s personal use only. Pursuant to Orange County Code, a daycare home is permitted for up to 10 children consisting of 5 children and 5 of their siblings. The applicant currently has only 6 children and does comply with that requirement. Furthermore, the applicant does have an approved occupational license and valid state certification. There was no opposition present at the public hearing.
