Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that no comments were received in favor of the request, and one (1) comment that was outside of notice area was received in opposition to the request. The applicant discussed the staff recommendation of denial, noting the reason for the proposed location of the pool equipment is due to the home location and configuration is not the original design that allotted space for the pool equipment to meet code. Further, diminishing the deck size to provide space for the pool equipment to meet code would be an eyesore since the location would place the pool equipment near the middle of the rear yard. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the request determining the proposed pool equipment would be located in the same area and there is a lack of a number of alternatives, and unanimously recommended approval of the Variance by a 6-0 vote, with one absent, subject to the four (4) conditions found in the staff report.
