Request: Variance in P-D zone to construct swimming pool and spa 25 ft. from normal high water elevation of Lake Tibet Butler in lieu of 30 ft. (NOTE: Portions of the proposed pool and spa encroach inside the required setback area).

Hearing: The applicant is requesting to construct a swimming pool and spa 25 ft. from the normal high water elevation of Lake Tibet Butler in lieu of 30 ft. The applicant stated that the existing seawall had fallen over and erosion has claimed approximately 10 ft. of depth of his property during the last few years. Only a corner of the pool and spa are actually encroaching into the setback. A berm and swale is proposed and depicted on the site plan. The applicants submitted (2) letters of support with their application including approval from the president of the Bentley Park Homeowners Association. Staff also received approval from the Orange County Environmental Protection Division subject to conditions, which staff incorporated into their conditions of approval.
