Hearing: SYNOPSIS: Staff gave a presentation on the case covering the location of the property, the site plan, and photos of the site. The applicant confirmed that they will facilitate the removal of a portion of the structure that extends into the rear easement. The BZA pointed out that similar variances had not been approved in the area, and asked about neighbor opposition to the request. The BZA inquired how the applicant would remove the rear part of the structure, and questioned the reason he could not remove the entire structure, which was built in 2019. Staff received no commentaries in favor of the application and one (1) in opposition to the application. There was no one present to speak in favor or in opposition to the request. The BZA made a motion to approve the requested variance, which passed with a 4-3 vote, subject to the six (6) conditions found in the staff report.
