Request: Variance in PD zone to erect swimming pool, pool deck, and pool enclosure zero feet from rear property line in lieu of 5 ft.

Decision: Approved

Hearing: The property is located in Eastwood. The applicant submitted letters in favor from his neighbors and also from the homeowner's association. Mr. Young stated his wife needs hydrotherapy due to a medical condition. He submitted a note from the doctor that recommended an at-home swimming pool. It was noted that the backyard abuts a retention pond. However, Staff and BZA have routinely expressed concerns about zero (0) setbacks, and have consequently recommended increased setbacks. The applicant was aware of the concern and stated he spoke with the pool contractor about it. This is the smallest pool size available, but there is sufficient room to pull the project back one foot from the property line. Based on all the circumstances, the BZA approved the variance for a one (1) foot setback.
