Request: Special Exception and Variance in the R-T-2 zoning district as follows: 1) Special Exception: To allow a detached Accessory Dwelling Unit (ADU) for applicant's mother; and, 2) Variance: To allow a 1,440 sq. ft. ADU in lieu of 604 sq. ft.

Decision: Denied

Hearing: The applicant proposes to place a mobile home on the property for her use and her mothers use. Her daughter resides in the existing mobile home on-site. Staff advised the BZA that it had received numerous citizen inquiries since the staff report was completed. Also, there are pending zoning code violations on-site. The property is scheduled to appear before the Code Enforcement Board on January 18th, 2017. The applicant addressed the BZA and advised as to her objective and intent to resolve the code violations. A neighbor spoke in opposition. She submitted numerous photos of the property's current conditions. The photos showed trash, tires, many barrels, numerous campers, poultry, unauthorized sheds and concrete. The neighbor indicated the campers were occupied by residents and had no power. The photos characterized this property as severely non-code compliant. The code enforcement officer spoke. He answered the BZA's questions and indicated the owner added additional items since his last inspection in December of 2016. The BZA concluded this request did not meet the special exception criteria and advised the applicant to resolve the numerous violations on-site.
