Summary of the decision
VA-23-05-026 — Timothy Schutz
Request: Variances in the R-1 zoning district for new lots as follows: 1) To allow Lot 1 with a lot width of 49.35 ft. in lieu of 50 ft. 2) To allow Lot 3 with a lot width of 49 ft. in lieu of 50 ft.
Decision: Approved
Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for approval. Staff noted that one (1) comment was received in support, and no comments were received in opposition. The applicant noted the requests for 12 inches and 8 inches are as minimal as possible, and that they have to provide access to the lot to the east. The BZA noted state law prohibiting blocking access to a property. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the variances and stated justification for the six (6) criteria and unanimously recommended approval of the variances by a 5-0 vote, with two absent, subject to the three (3) conditions found in the staff report.
