Summary of the decision
VA-24-06-047 — Meagan Anderson
Request: Variance in the PD zoning district to allow an attached Accessory Dwelling Unit (ADU) with a north rear setback of 21.7 ft. in lieu of 35 ft. Note: This is a result of Code Enforcement
Decision: Approved
Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that no comments were received in favor or in opposition to the request. The applicant team described the rationale for constructing the addition to provide space for family. Furthermore, the contractor did not pull permits as implied. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the request determining the applicant made every attempt to complete the project with permits and there appears to be similar setback in the surrounding community and unanimously recommended approval of the Variance by a 5-0 vote, with one absent and one seat vacant, subject to the four (4) conditions found in the staff report.
