Summary of the decision
VA-04-03-129 — Hearl H. Brogan, Jr.
Request: Variance in P-D zone to allow existing carport to remain 1 ft. from side property line in lieu of 6 ft. (NOTE: This case is a result of Code Enforcement Division action. The applicant purchased the property in 1995 with the existing carport).
Decision: Denied
Hearing: The applicant is asking for an attached carport to remain 1 ft. from the side property line in lieu of 6 ft. A code violation was issued to the applicant following a complaint received from the adjacent property owner due to drainage issues associated with the structure. The applicant stated that the structure was present when he purchased his home and that it was utilized for a storage area for miscellaneous items not for vehicles. There are no permits on record for this structure. The Board denied the request finding that the structure was to close to the property line resulting in lack of privacy and drainage problems to the adjacent property owner and there was adequate space in the backyard for a detached accessory building for storage purposes.
