Summary of the decision

VA-03-09-097 — Don Kallow

Request: Variance in R-CE (single family-1 acres lots) zone to construct single family residence at 115 ft. lot width line in lieu of 135 ft.

Decision: Denied

Hearing: The applicant wants to construct a single-family residence at the 115 ft. lot width line in lieu of the 135 ft. lot with line. The subject property is located within the Graceland Subdivision. A permit was issued for the single-family residence in April of 2003 in compliance with applicable zoning regulations. The applicant decided the home was setback too far back from Rolling Hills Dr. and wished to relocate the proposed home closer to the roadway. Staff recommended denial of this request finding that it did not meet the zoning variance criteria. Several residents in the Graceland Subdivision spoke in opposition. They felt approving the request would set a undesirable precedent for this community. The BZA agreed.
