Request: Special Exception in R-1 (single family 5,000 sq. ft. lots) zone to convert existing single family residence into a child day care center for up to 25 children and Variance to provide 3 parking spaces in lieu of 6 spaces.

Hearing: The Staff Report and Recommendation is located on Pages 109, 110 and 111. In response to staff's concern about providing adequate on-site parking, the applicant stated they would van-transport some of the children, and that they would be able to revise the site plan to accommodate four parking spaces. With four parking spaces, a maximum of 20 children are allowed by Code. Several commentaries were received, both in favor and in opposition. The opposition was from the neighborhood across the street to the east, and the primary concern was traffic. The applicant agreed to reduce the number of children from 25 to 20 in order to meet parking code. He agreed to the other conditions proposed by staff. The BZA changed the fencing type in the rear yard from wood to vinyl due to its long-standing durability.
