Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that two (2) comments were received in support, and one (1) comment was received in opposition. The applicant stated that there are screen enclosures in the area that are closer to the property line, and that trees block the view of the structure. He also stated that they would accept a variance of 5 feet rather than 10 feet. The BZA noted that they are constrained by the pool and deck. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the Variance and stated justification for the six (6) criteria and unanimously recommended approval of the Variance by a 5-0 vote, with one absent and one vacant, subject to the four (4) conditions found in the staff report, and an amended condition 1 to state, "Development shall be in accordance with the dimensions as shown on the site plan and elevations, as modified to provide a minimum 25 ft. rear setback."
