Request: Variances in R-CE (single family-1 acre lots) zone to construct a single family residence on substandard lot as follows: 1. 100 ft. of lot width in lieu of 130 ft.; 2. .31 acres of land area in lieu of 1 acre; 3. 20 ft. from front property line in lieu of 35 ft.

Decision: Approved

Hearing: The subdivision was administratively rezoned from R-1A to R-CE in 1981 pursuant to the adoption of the Orange County Growth Management Policy. A number of homes were built under the previous R-1A performance standards. One Variance was granted to allow new construction on similar substandard lot size and width in the neighborhood. Staff recommended a five foot increase (to 25 ft.) in the front yard setback, which is consistent with the R-1A requirement under which the older homes were required to meet. The BZA recognized that increasing the front yard setback meant decreasing the rear yard setback to 43 ft. (versus 50 ft. under R-CE), which, however, is in excess of the 30 ft. setback required under R-1A. There was no opposition to this request.
