Request: Variances in the R-3 zoning district as follows: 1) To allow an existing house with an east side setback of 1.4 ft. in lieu of 5 ft. 2) To allow an existing 327.4 sq. ft. accessory structure with an east side setback of 1.7 ft. in lieu of 5 ft. 3) To allow an existing 327.4 sq. ft. accessory structure with a south rear setback of 3.7 ft. in lieu of 5 ft. 4) To allow an existing 175.9 sq. ft. accessory structure with an east side setback of 0.5 ft. in lieu of 5 ft. Note: This is the result of Code Enforcement.

Decision: Approved

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for approval of the Variance #1 and denial of Variances #2, #3 and #4. Staff noted that one (1) comment was received in support, and no comments were received in opposition to the request. The owners discussed the need for the request and indicate that the have have been in the same location since for about 20 years. Code Enforcement discussed the citation and provided history of the case. There was no one in attendance to speak in favor of the request and one person was in attendance to speak in opposition to the request. The BZA discussed the construction of the sheds, the location of the existing improvements and unanimously recommended approval of Variance #1 and denial of Variances #2, #3 and #4 by a 4-0 vote, with two absent and one vacant, subject to the three (3) conditions in the staff report, as amended to delete Condition #4.
