Request: Variances in R-3 (multifamily) zone to construct parking garages in conjunction with existing apartments as follows: 1) 0 ft. from side property lines (north and south) in lieu of 10 ft.; 2) 5 ft. from rear property line (east) in lieu of 30 ft.

Decision: Denied

Hearing: The property is located in a multifamily rental community that is primarily intended for student housing near UCF. The applicant stated he wanted to erect garage units because his tenants complain that people from other neighboring units park in their spaces. He stated also the garage units would help make the project more marketable. Staff could not support the request in that there is insufficient space on the property to accommodate the units without conflicts. The issues are explained in the attached memorandum report (See Pages -------). The applicant submitted two letters from adjacent property owners to the north and south. However, those letters indicated the writers were more interested in a fence the applicant is proposing to separate their properties. The BZA felt the request did not any of meet the Variance criteria. They felt it was too much construction in a narrow space and would cause traffic safety problems within the parking lot. Further, there are other options to prevent vehicular trespass other than the applicant's variance proposal. Therefore, the BZA denied the request. There was no public input at the hearing.
