Hearing: The applicant is proposing to relocate their existing equine center which is currently located north of the proposed site. The facility is a horse boarding facility which provides therapy for children and adults. Staff outlined the location, the proposed site plan, elevations, and special exception criteria. Staff explained that there are two other equestrian centers in the area and this is located in the Avalon Rural Settlement. This area is compromised of agricultural uses, single family homes, and other rural uses. Staff recommended approval of the request as it met the criteria outlined in section 38-78. Staff deemed the variance to be unnecessary as the Lake Avalon Rural Settlement Commercial Design standards only speak to commercial and office development. Since this is a non-profit entity these standards do not apply. The applicant agreed with staff's recommendation and mentioned they would like to amend condition #5. They stated some staff members may staff overnight from time to time to care for the animals on site. The BZA discussed the proposal and changes to the condition regarding living quarters. The board amended condition #5 and approved the special exception request as it met the criteria.
