Request: Variances in the R-CE zoning district as follows: 1) To allow an addition with a front setback of 20.8 ft. in lieu of 35 ft. 2) To allow an existing residence with a front setback of 29.8 ft. in lieu of 35 ft. 3) To allow an existing residence with a Normal High Water Elevation (NHWE) setback of 42.2 ft. in lieu of 50 ft.
Decision: Approved
Hearing: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for approval. Staff noted that one (1) comment was received in favor of the request, and no comments were received in opposition to the request. The applicant was present and noted that the request is for a small exercise room. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the that the second and third requests are only under consideration because of the first request, and that they are just recognizing the existing condition. They noted that this is a very small addition and the subject lot is one of the smallest lots in the area, creating a special condition. The BZA unanimously recommended approval of the Variance by a 7-0 vote, subject to the four (4) conditions found in the staff report.
Conditions: 1) Development shall be in accordance with the site plan date stamped April 8, 2025, and elevations dated February 6, 2025, subject to the conditions of approval, and all applicable laws, ordinances, and regulations. Any proposed non-substantial deviations, changes, or modifications will be subject to the Zoning Manager's review and approval. Any proposed substantial deviations, changes, or modifications will be subject to a public hearing before the Board of Zoning Adjustment (BZA) where the BZA makes a recommendation to the Board of County Commissioners (BCC).
