Hearing: SYNOPSIS Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial for the variance. Staff noted that as of the date of the meeting, one (1) comment was received in favor of the request. This was a correction to what was stated in the staff report. Staff also noted that no comments had been received in opposition to the request. The applicant discussed the recommendation of denial, and why Orange County Code Sec. 38-1426 was overly restrictive as applied to his specific property because lot/parcel is very deep and the structure could not be seen from the street. The applicant continued by providing a detailed presentation that highlighted why this particular siding material was necessary for the proposed structure he intended to erect. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the requests, determining the requests as proposed would be similar and compatible with the surrounding area and recommended approval of the Variances by a 3-2 vote, with one absent and one seat vacant, subject to the three (3) conditions found in the staff report, Condition #1 as follows, Development shall be in accordance with the site plan and elevations dated February 10, 2024, subject to the conditions of approval, and all applicable laws, ordinances, and regulations. Any proposed non-substantial deviations, changes, or modifications will be subject to the Zoning Manager's review and approval. Any proposed substantial deviations, changes, or modifications will be subject to a public hearing before the Board of Zoning Adjustment (BZA) where the BZA makes a recommendation to the Board of County Commissioners (BCC).
