Request: Variances in A-1 (agricultural) zone as follows: 1) To allow detached accessory building (storage building) to remain with 2,250 sq. ft. of floor area in lieu of 2,000 sq. ft.; 2) 16 ft. in height in lieu of 15 ft.

Hearing: The request is to allow a detached accessory building to remain 2,250 sq. ft. in lieu of 2,000 sq. ft. and 16 ft. in height in lieu of 15 ft. The Orange County Building Division issued a violation in November of 2003, after the applicant had constructed the storage building without the appropriate permits. The applicant submitted three letters of no objection from property owners to the south and east. Three citizens spoke at the public hearing in opposition to this request due to the visual impact of the structure. In addition. Eleven commentaries were received in opposition. In their denial of the request, the BZA noted the applicant could physically modify the structure by removing a section and thereby reducing the size to 2,000 square feet, and modifying the roofline by one foot. BZA felt, under the circumstances, this request did not meet the variance criteria.
