Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for approval of the Special Exception and an analysis of the six (6) criteria and the reasons for a recommendation for denial of the Variance. Staff noted that no comments were received in support and one (1) comment was received in opposition. The applicant stated that they are requesting the garage because they do not want cars or equipment to be visible from the street. The applicant also provided an approval letter from the HOA and from 8 other neighbors. The owner stated that he collects cars and needs them inside, and needs a lot of equipment to maintain the property. The owner also stated that a contractor he hired had told him that permits were not necessary He noted that the proposed building is over 500 ft. from the road, and the neighbors are ok with the proposal. The BZA discussed the implications of approving the Special Exception and denying the Variance, to allow the construction of 2 separate buildings.There was no one in attendance to speak in favor or in opposition to the request. The BZA recommended approval of the Special Exception, and denial of the Variance by a 7-0 vote, subject to the seven (7) conditions in the staff report, as amended to allow construction of 2 buildings.
