Summary of the decision
SE-04-09-155 — Pine Hills Athletic Club
Request: "Special Exception in P-O (professional office) zone to renew previously approved membership sports and recreation club (Pine Hills Athletic Club) and to include adjacent parcel for parking. (NOTE: On July 5, 2001, the BZA approved private sports and recreation club. Condition # 7 approved use for 3 years which expired in July of this year).
Decision: Approved
Hearing: "The Staff Report and Recommendation is located on Pages____ Winston Moxey, property owner and member of the club, requested a permanent approval of the Special Exception and Variance. The BZA was not comfortable with that request. The BZA noted that circumstances could change with respect to the future ownership of the property and Mr. Moxey's relationship between the club and himself as the property owner. There was a secondary concern about possible nuisance or safety impacts on the area, given the number of calls placed to the Sheriff's Department involving this property in the past three years (see Sheriff's report attached to Staff Report). Mr. Moxey requested at least a five year period if the BZA imposed another time limit. The BZA did impose a five year time frame. There was no opposition present at the BZA hearing."
