Request: Special Exception in R-1A zone for children's day care center (up to 100 children) and Variances as follows: 1. eliminate 10 foot wide landscape buffer required on north side of property adjacent to residentially zoned lands; 2. provide a 5 foot wide landscape buffer in lieu of 10 ft. on east side of property adjacent to residentially zoned lands.

Hearing: The applicant wants to convert an existing warehouse type building into a child day care facility for up to 100 kids. Staff presented its findings and recommendation. Staff felt the request was too intrusive for the adjacent neighbors. The applicant informed the BZA that he met with the residents but could not satisfy them. Approximately 16 residents were at the public hearing to speak in opposition. They stated privacy and noise concerns. In addition, they felt the community has plenty of non-residential land uses. In summary, the community does not embrace this request. The BZA agreed that the request would be detrimental to the area residents.
