Summary of the decision
SE-01-09-067 — Timothy F. Diel
Request: Special Exception in R-1A zone to allow attached accessory dwelling unit to remain and Variance to allow a 7.5 ft. rear yard setback in lieu of 30 ft.
Decision: Approved
Hearing: The Staff Report and recommendation is located on Pages _____. Two commentaries were received in opposition from abutting property owners. Their concerns were the poor appearance of the sections that had been added onto the house, and that the unit would be rented out as a multifamily dwelling. A neighbor from across the street was at the hearing and stated he would have no objection as long as the unit was for the use of immediate family members only. The BZA was concerned about the density and the appearance of the buildings on the property. They felt the variance on the setback should be reduced and that the kitchen should be removed to avoid a potential violation. Also, the BZA wanted a run-down shed existing close to neighbors' properties either replaced or repaired. The BZA advised the applicant to seek professional assistance to ensure the building sections would meet building and safety codes. The applicant agreed to abide by the conditions imposed by the BZA.
