Hearing: The applicant is asking for an existing single-family residence to remain 17 ft. from the front property line in lieu of 20 ft. In this subdivision there are two front yard setbacks one for the single-family residence and one for the front porch. Typically, there is only one front yard setback for a subdivision and/or the designated zoning district. Both staff and the applicant were confused with the requirements at the time of development permitting and permits were issued in error. The BZA approved the request finding the 3 ft. deviation to be a minimal encroachment, that these were model homes in a new subdivision, and that there would be no adverse impacts to any surrounding property owners. The applicant did submit a letter of approval from the homeowners association. There was no opposition to this request.
