Request: Variance in the A-2 zoning district to allow a detached accessory structure (pergola) with a 40 ft. setback from the Normal High Water Elevation (NHWE) in lieu of 50 ft.

Hearing: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation of approval of variance. The applicant agreed with staff's presentation and had no further comments. The BZA discussed the request, and the lesser approval from the previous cabana in the same location. The BZA recommended approval of the Variance by a 5-0 vote, with one seat vacant, subject to the four (4) conditions found in the staff report.
