Request: Variance to erect single family residence 10 feet from side of property line in lieu of 25 feet. NOTE: The applicant's proposed residence encroaches into the 25 foot P-D perimeter setback.

Hearing: The property is located in the Vizcaya Subdivision. It was platted in September of 2000. The applicant is proposing to build a 6,700 square foot home. The side of the home will encroach 15 feet into the setback. The applicant stated he needed this size home for his extended family. He felt the need for the variance was the result of the shape of the lot. A board member of the Granada Villas Homeowners Association spoke in opposition. She stated the developer committed to abiding with the 25 foot setback and now they are violating it. Two (2) adjacent property owners to the south spoke in opposition. They felt the request would further infringe on their privacy. They stated the homes in Vizcaya were constructed at a higher elevation without the variance. The BZA felt the hardship was related to the size of the home not the shape of the lot. Staff received 2 commentaries in opposition.
