Request: Variances in R-2 (residential 1-4 unit structures) zone to construct a duplex on each of five (5) lots as follows: 1) 50 ft. lot width in lieu of 80 ft.; 2) 6,750 sq. ft. of lot area per lot in lieu of 8,000 sq. ft. (NOTE: The applicant wants to build a duplex on each of 5 lots for a total of 10 dwelling units). Approved w/conditions (9/2/2004)

Hearing: Staff prepared a report with findings and a recommendation on this Variance request. See Pages ---------------, which was sent to the BZA members and the applicant prior to the public hearing. A letter in opposition was received from a neighboring homeowner. The writer's concern was that this request would congest the neighborhood and would be contrary to single family homeownership. The writer's letter is attached (see Page ----------). The applicant stated he builds a quality housing product and requested the BZA grant him the requested 10 dwelling units. The BZA reviewed the photos taken of the applicant's other housing projects in the area and acknowledged the quality housing. However, the BZA explained the issue was not quality housing but compatibility with the area, consistency with past decisions on similar cases, consistency with the CPP, and compliance with the Variance criteria. The BZA, therefore, agreed with the staff recommendation and granted a Variance for eight (8) dwelling units.
