Request: Variance in the A-2 Zoning district to allow a 2,484 sq. ft. (69x34) basketball court to be located in the front yard.

Decision: Approved

Hearing: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation of denial for the variance. The applicant discussed the existing site conditions and how they were trying to permit the court that was there when they purchased the property. The BZA discussed the request, and noted that the site is a very large lot with significant vegetation between the basketball court and the street. Due to these circumstances, and the fact that the current owner did not create these conditions, the BZA felt the request was similar to other variances approved elsewhere in the County. The BZA recommended approval of the Variance by a 5-0 vote, with one seat vacant, subject to the four (4) conditions found in the staff report.
