Request: Variances in R-1 (single family-5,000 sq. ft. lots) zone to allow existing addition to single family residence to remain as follows: 1. 3 ft. from side property line in lieu of 6 ft.; 2. Less than 25 ft. from front property line. (NOTE: The property owner was cited by Code Enforcement Division)

Decision: Denied

Hearing: This was a complaint-based violation cited by Code Enforcement last summer and eventually referred to the Code Enforcement Board. The structure was built without permits and in violation of zoning setbacks. The subject is a wooden, two-sided structure abutting the front of the carport and situated in the driveway. The applicant stated they use it for outdoor recreation, such as for BBQ's. Staff reported the structure is five feet away from the front property line. It sticks out far beyond all the other structures along the street. Furthermore, the location of the structure blocks the driveway and carport, necessitating vehicular parking in the front yard. Staff showed photos of the front yard being used to park three cars on a regular basis. Staff recommended denial of the request in that the structure is a detrimental aesthetic impact to the neighborhood, and it did not meet the variance criteria. The BZA agreed and denied the request. There was no public opposition.
