Request: Variance in the A-1 zoning district to allow a detached accessory structure in front of the primary structure.

Decision: Approved

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that two (2) comments were received in support, and no comments were received in opposition. The applicant noted that the structure will be 91 feet from the front property line and that they have a loop driveway and it would make more sense to have the garage in front of the house. They also noted that the proposed location is in a clear area, and if they built the structure further back, trees would need to be removed. The BZA confirmed the size of the structure and noted the constraints on the property and the 91 foot setback as well as the preservation of trees be placing the structure in an open area, and discussed the appearance to match the house. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the variances and stated justification for the six (6) criteria and unanimously recommended approval of the variances by a 5-0 vote, with two absent, subject to the four (4) conditions found in the staff report, and the addition of a fifth (5th) condition to state, ¿The accessory structure shall be constructed of the same materials and be painted to match the house.¿
