Summary of the decision
VA-23-01-146 — Eduardo Bertinatti
Request: "Variances in the R-1A zoning district as follows: 1) To allow a carport addition with an east front setback of 13 ft. in lieu of 25 ft. 2) To allow an addition with a north side setback of 4.29 ft. in lieu of 7.5 ft. Note: This is the result of Code Enforcement."
Decision: Approved
Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that six (6) comments were received in favor of the application, and no comments were received in opposition. The applicant described that the rationale for constructing the carport in the current location was due to the angle of the house on the property and the covered patio designed along the line of the house. There was no one in attendance to speak in favor or in opposition to the request. Code enforcement staff discussed history of citation. The BZA discussed the request and determined the angle of the house relative to its location on the lot which reduces the distance to meet the setback, and unanimously recommended approval of the variance by a 7-0 vote, subject to the four (4) conditions in the staff report.
