Request: Variances in the R-T-1 zoning district to allow a mobile home as follows: 1) A side street setback of 11.7 ft. in lieu of 15 ft. 2) A west side setback of 3.7 ft. in lieu of 5 ft.
Decision: Approved
Hearing: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation of approval of the Variances. Staff noted that no correspondence was received in favor, and one comments was received in opposition to the request. The applicant was present and described their justifications for requesting the Variances noting that he is assisting his father with the mobile home. He also stated they had hired a contractor to install the mobile home and obtain the correct permits, but they abandoned the job. The applicant went on the state that they were unable to shift the mobile home to comply with the setbacks due to the width of the home. BZA discussed that mobile the home is placed on the property but will still need to receive all required permits. They went on to state the width of the house and lot do not allow stairs to be placed in a code compliant location. There was no one in attendance to speak in favor and one individual spoke in opposition to the request. The individual stated he is the direct neighbor to the subject property and that the stairs are too close to his property and the Variance request was inaccurate. The BZA recommended approval of the Variance as requested by a 6-0 vote with one (1) absent, subject to the three (3) conditions found in the staff report.
Conditions: 1) Development shall be in accordance with the site plan and elevations received July 10, 2025, subject to the conditions of approval, and all applicable laws, ordinances, and regulations. Any proposed non-substantial deviations, changes, or modifications will be subject to the Zoning Manager's review and approval. Any proposed substantial deviations, changes, or modifications will be subject to a public hearing before the Board of Zoning Adjustment (BZA) where the BZA makes a recommendation to the Board of County Commissioners (BCC).
