Request: Variances in the R-1A zoning district as follows: 1) To allow a screen room 6.8 ft. from the side property line in lieu of 7.5 ft. 2) To allow an existing accessory structure to remain in front of the principal building in lieu of the side or rear. 3) To allow the existing residence to remain 4 ft. from the property line in lieu of 7.5 ft.

Decision: Approved

Hearing: The applicant would like to construct a screen room at the rear of her existing residence. The existing house encroaches on the side setback and the applicant would like to keep the screen room in line with the house. Staff explained that this a double frontage lot and to allow the shed to remain where it is would require a variance. Also, a permit is required for the shed as staff could not locate a permit. The applicant stated they would like to get a permit and construct the screen room as soon as possible. She stated she does not agree with condition #4 as she would like to pull the permit for the shed after she constructs the screen room. The board discussed the condition requiring a permit for the shed and the timing of the permits. The BZA agreed the variances were reasonable and approved the request. They amended condition #4 requiring a permit to be pulled for the existing shed within 180 days of final approval.
