Hearing: The applicant is seeking relief of an existing encumbrance on the subject property's title. The applicant gave an overview of the problem and stated the many avenues he has taken to remedy the problem.

Staff noted if the BZA approves the request, the approval is only for the building setback and not for the utility easement encroachment. The applicant was made aware to confer with Public Works Engineering division to resolve the easement issue, and a condition is in place to address this concern.

Two commentaries were received in favor and none in opposition. The BZA noted the applicant's hardship was not self-created and unanimously approved the request with conditions.
