Request: Special Exception in A-1 zone to expand existing Class III landfill. (NOTE: Applicant proposes to add approximately 50 acres of land to the southwest side of existing landfill on the south side of Keene Road and east side of McQueen Road).

Hearing: The staff report is attached. Staff gave its presentation. Staff felt that the protection of the McQueen Road residents superceded the fact that there are industrial uses in the general area. The applicant proposed conditions of approval and an unsigned Developers Agreement. Three area residents expressed concerns about the request. They felt the request could affect their property values. A spokesperson for the McQueen Road residents spoke in favor of the request. He stated he had a petition with 12 signatures in favor from the residents of McQueen Road. He stated the residents were mainly concerned about obtaining greater use of their own properties and obtaining additional urban services. The BZA felt the conditions of approval and the execution of the Developers Agreement would improve the residents' present conditions. Staff received 12 commentaries in opposition.
