Request: Variances in R-1 (single family-5,000 sq. ft. lots) zone as follows: 1. Allow existing two story residence to remain 5 ft. from side property line on south in lieu of 6 ft.; 2. Construct second story addition 5 ft. from side property line on south in lieu of 6 ft.; 3. Allow existing covered patio to remain 1 ft. from side property line on south in lieu of 6 ft.; 4. Allow existing shed to remain 2 ft. from side property line on south in lieu of 5 ft.
Decision: Approved
Hearing: The property owner to the south registered a letter of no objection to the proposed variances. The applicant stated the house has been located on-site since 1991. The property has been in the family for many years. As to the structure referred to in Variance #4 (shed), the applicant stated this was the original homestead residence of his parents. It was noted that the applicant had originally intended to tear down both the covered porch and shed, but that he had changed his mind and decided to request the variance so he could have more storage space. The BZA felt Variance #1 and #2 were reasonable, but that there was no hardship for the shed and the covered porch. The BZA denied Variance #4. As to Variance #3, the district BZA member felt the support posts could easily be relocated and lined up with the existing house. Therefore, a one-ft. variance was granted to allow the covered porch five ft. away from the property line consistent with that of the house. There was no opposition to this request.
