Request: Special Exception in R-1 zone for day care facility for up to 80 children and 10 employees and Variance from the required 10 foot wide landscape buffers where adjacent to residential uses (north and west sides of property).
Decision: Denied
Hearing: The applicant wants to add square footage to the existing residence and convert the use to a child day care facility. Staff presented its findings (see Staff Report). Staff's position is this section of Clarcona-Ocoee Road is still viable for single family uses. Approval of this request would create additional pressures on Orange County to commercialize this section of roadway. In addition, a similar request was denied by the BZA for a parcel to the east. The applicant stated he held a community meeting but only three (3) residents attended. He stated he could scale down the project. The BZA felt the use was not appropriate at this location and felt approval would establish a commercial precedent along this roadway. There was no opposition at the hearing. Staff received four (4) commentaries in opposition and none in favor.
