Summary of the decision
SE-99-07-006 — Donald Rutledge
Request: For Special Exception in R-1 zone for accessory dwelling unit.
Decision: Approved
Hearing: The property is located in the Kingswood Manor subdivision. The applicant bought the property with a second house in the rear yard; it had been advertised as "mother-in-law" quarters. His daughter resides in the second house to help care for him; he is a disabled veteran. A complaint had been filed with Code Enforcement, and the applicant agreed to file the Special Exception request to resolve the violation. Staff research indicated the subject building had been a garage in the 1970's. At some point, an owner expanded the building and illegally converted it into living quarters. Approval of the request will require the applicant to obtain "after-the-fact" permits to ensure health and safety codes can be met. The applicant submitted a petition with approximately two dozen signatures in favor of the request. There was no opposition.
