Hearing: The applicant submitted a letter of approval from Deer Lake Chase Homeowner's Association and a letter of no objection from adjacent neighbors whose property abuts the side and rear yard property lines. Staff received a total of nine commentaries in favor of the proposed request and seven in opposition. The opposition shared concerns of the proposed structure being used for habitable space or a business occupation. Staff imposed conditions to address the opposition concerns. The applicant also informed the BZA that he conferred with some residents who were opposed and they have since submitted a petition in support.

A similar variance was granted by the BZA for a 912 square feet detached accessory building in this subdivision.

The BZA approved the request with amended conditions of approval. There was no opposition at the public hearing.
