Summary of the decision
VA-26-01-082 — Derek Walters
Request: Variance in the I-2/I-3 zoning district to allow a dumpster to be located in the front yard in lieu of side or rear yards.
Decision: Approved
Hearing: Derek Walters: Staff presented the proposal, outlining the property¿s location, site plan, and site photographs. Staff also reviewed the six required criteria and explained the basis for recommending approval of the variance request. It was noted that no public comments were received in support of the request and that one comment was received in opposition. The applicant, who was present, stated that they were in support of Staff¿s recommendation. The applicant provided additional details as the location, and operation of the site. The BZA asked questions regarding the determination of double frontage and the exact location of the proposed dumpster. After discussion, the BZA determined that the request was appropriate due to the limited options available for dumpster placement and agreed that, based on the double frontage definition, the proposed location was acceptable. No members of the public were present to speak in favor of or in opposition to the request. The BZA recommended approval of the variance request by a 5¿0 vote, with two members absent, subject to the six conditions outlined in the staff report.
Conditions: 1) Development shall be in accordance with the site plan date stamped August 11, 2025, subject to the conditions of approval, and all applicable laws, ordinances, and regulations. Any proposed non-substantial deviations, changes, or modifications will be subject to the Zoning Manager's review and approval. Any proposed substantial deviations, changes, or modifications will be subject to a public hearing before the Board of Zoning Adjustment (BZA) where the BZA makes a recommendation to the Board of County Commissioners (BCC).
