Request: Variance in the R-1AA zoning district to allow a detached accessory structure (garage) in front of the primary structure.

Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for approval. Staff noted that four (4) comments were received in support, and no comments were received in opposition. The applicant stated that they agree with everything, except the fence issue, and they want the condition removed, as they feel that the fence was permitted. The applicant also stated that the sheds will be removed and the carport will be permitted. The BZA noted that all houses in the area are on septic, and many are narrow lots, and it would be impossible to put this improvement in the rear yard. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the variance and stated justification for the six (6) criteria and unanimously recommended approval of the variance by a 7-0 vote, subject to the five (5) conditions found in the staff report, and an amended condition 5 to remove reference to the fence.
